CrossCountry Find Your New Prize Draw Terms & Conditions




  1. The prize draw promotion is called the “Find Your New” prize draw and is operated by XC Trains Limited whose registered office address is c/o 1 Admiral Way, Doxford International Business Park, Sunderland SR3 3XP (the “Promoter”).


  2. By entering into the prize draw, participants agree to be bound by and comply with these terms and conditions. Any information or instructions published by the Promoter about the prize draw on the webpage set out at condition 5 below (and any pages linked thereto) shall be deemed to form part of these terms and conditions.


  3. The prize draw is open to all UK residents aged 18 years or over, except employees of the Promoter, their families, agents or any third party directly associated with administration of the prize draw.


  4. The prize draw is free to enter and no purchase is necessary.


  5. All entries must be submitted only via www.crosscountrytrains.co.uk/findyournew. Entries made by any other means will not be valid and will not be entered into the prize draw so participants should leave sufficient time to submit their entry(ies) via the above webpage. Individuals may make multiple entries to the prize draw.


  6. The opening date for entries is 09.00 on 15 June 2015. The closing date of the prize draw is 23.59 on 6 September 2015. Entries received after this time will not be valid or entered into the prize draw. The date and time of the closing of the prize draw will not change unless the Promoter is forced to do so for reasons outside its reasonable control. If this occurs the Promoter will notify entrants and take reasonable steps to ensure that they are not disadvantaged.


  7. All prize draw entries made via the CrossCountry website must include the participant’s name, contact e-mail address and a photograph of a new location the participant has visited in the format and form referred to on the relevant webpages. Any incomplete entries will not be entered into the prize draw..


  8. By uploading an image (or images) to the CrossCountry website as part of an entry the participant:

    8.1 grants to the Promoter a royalty free, irrevocable, sub-licensable licence to use any and all of the images uploaded by the participant in any media, for any lawful purpose in perpetuity. The Promoter may grant viewers and users of the Promoter’s website the right to freely share the uploaded images on any and all social media platforms;

    8.2 confirms that he/she has the right and authority to enter and upload the images into the prize draw and that he/she has the right and authority to grant the rights given in these terms and conditions; and

    8.3 confirms that use by the Promoter and third parties of the image(s) will not infringe any intellectual property, proprietary or any other rights of any third party.


  9. Any image uploaded pursuant to the prize draw must:

    9.1 be the original work of the participant uploading the image as part of his entry into the prize draw;

    9.2 not contain any derogatory, discriminative, illegal or otherwise offensive material (determined in the sole discretion of the Promoter);

    9.3 comply with all applicable law and regulation.


  10. If, in the sole discretion of the Promoter, any image does not appear to comply with these terms and conditions, then the relevant entry to the prize draw shall be disqualified immediately and the Promoter shall notify the participant in question of the same as soon as possible.


  11. The Promoter accepts no responsibility for entries not successfully completed due to a technical fault, technical malfunction, computer hardware or software failure, satellite, network or server failure of any kind, the Promoter does not take any responsibility for any entries which are not completed by the closing date and time set out in condition 6 above.


  12. Three winners will be chosen by random draw performed by a computer process within 5 days following closure of the prize draw (the actual date of such draw being the “11th September").


  13. Each of the winners will receive the following prize:

    13.1 two first class return to anywhere on the CrossCountry network;

    13.2 a 2-night stay in one room for two people at a hotel which the winner has chosen from a selection of hotels provided by the Promoter; and

    13.3 £250.00 spending money in aggregate per winner and guest.


  14. The winners will be notified by email (using details provided at entry) within 14 days of the Draw Date. If a winner does not respond to the Promoter within 30 days of being notified by the Promoter, then the winner's prize will be forfeited and the Promoter will be entitled to select another winner in accordance with the process described above.


  15. Confirmation of the rail tickets and hotel reservation will be sent to the winners by email within 14 days of notifying the Promoter of their preference. The £250.00 spending money will be provided to the entrant by way of a cheque within 14 days of prize confirmation


  16. The prize for the winners is non-exchangeable and non-transferable. No cash alternative is offered in respect of the rail or hotel reservations.


  17. The Promoter reserves the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond the Promoter’s control make it necessary to do so.


  18. The decision of the Promoter regarding any aspect of the prize draw is final and binding and no correspondence will be entered into about it.


  19. The winners’ names and counties can be obtained from 28 days after the end of the Draw Date by sending a stamped addressed envelope to the following address: Marketing Department, XC Trains Limited, 5th Floor, Cannon House, 18 The Priory Queensway, Birmingham B4 6BS.


  20. Participants are deemed to have accepted and agreed to be bound by these terms and conditions upon entry. The Promoter reserves the right to refuse entry, or refuse to award the prize to anyone in breach of these terms and conditions.


  21. The Promoter reserves the right to hold void, cancel, suspend, or amend the promotion where it becomes necessary to do so.


  22. Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.


  23. Winners may be required to participate in publicity related to the prize draw which may include the publication of their name and photograph in any media.


  24. Personal data supplied during the course of this promotion may be passed on to third party suppliers only insofar as required for fulfilment/delivery/arrangement of the prize.


  25. The prize draw will be governed by English law and entrants to the prize draw submit to the jurisdiction of the English courts.
